Federal rules changed in December 2006 to accommodate Electronically Stored Information. State rule changes are not far behind. Clients and Courts now expect that attorneys accurately and reliably advise the Court regarding the capabilities of their clients' electronic storage systems, including work stations, servers, archive and backup tape systems. Attorneys who wish to be able to practice using Electronically Stored Information must find ways to understand their clients' systems while engaging legal strategies to discovery opponents' electronically stored information, including information that makes the computer a witness in a matter. Meanwhile, changes in Ohio's code of ethics and professional conduct place limits on the ability of an attorney to protect ESI from discovery by a party opponent. This seminar will examine each of following functions and demonstrate real-world, proven strategies to incorporate electronically stored information: a. Investigation b. Litigation Hold c. Disclosures under federal rules d. Discovery under federal and State rules: use of Request for Production and Interrogatories to find ESI e. Review of ESI f. Production in Response to Discovery of ESI g. Ethical Issues Case law will be incorporated with technology so that attendees will understand the legal and technical issues that must be addressed in order to successfully and economically find, review, and use ESI in state and federal cases. Templates will also be provided so each attendee will have practice tools allowing them to immediately begin using ESI.
